Use of the site – General conditions

The User is defined as any person having access to the site, whatever their quality (private individual or professional), location, methods of connection to the site, and object or ultimate purpose of access to information published on the site.
The User may not take advantage of any difficulty in accessing the Site to access the information or flout these General Conditions of Use. The User’s complaints must be sent to the company by registered post (with acknowledgement of receipt) to the address indicated in the preamble.
The reproduction of all or part of this site on any medium whatsoever is strictly prohibited without the express permission of Bottoms Up and in particular:

• any extraction or reuse, including for private purposes, of a substantial part of content from databases constituted by the site;
• any repeated and systematic extraction or reuse, including for private purposes, of even a non-substantial part of content from databases constituted by the site;
• any adaptation, provision to the public (by request or otherwise), distribution, rebroadcasting in any form whatsoever, networking, public communication of all or part of the works, services, trademarks and all elements protected or likely to be protected by intellectual property law reproduced on the site.

Intellectual property

All the elements constituting this site (texts, graphics, software, images, sounds, plans, names, brands, logos, databases, etc.) as well as the site itself are the exclusive property of the company and are subject to French and international legislation on copyright and intellectual property. The User is prohibited from modifying, copying, reproducing, downloading, broadcasting, transmitting, commercially exploiting and/or distributing in any way whatsoever the services and pages, texts and photos of the site. The creation of hypertext links from a site to “www.bottoms-up.fr” also requires the express prior agreement of the company. The company may at any time modify the terms of these General Conditions of Use. These modifications commit the User as soon as they are published online. It is therefore recommended that the User regularly consult the General Conditions of Use in order to be fully aware of any new conditions.

Personal data

The company may be required to collect a certain amount of personal data. In application of the provisions of the modified French Law “Informatique et Libertés” (n° 78-17 of 6 January 1978), the User has the right to access, modify, rectify and delete any data concerning them. These rights can be exercised at any time by electronic means directly with the company at the address contact@bottoms-up.fr.

Cookies

The User is informed that during his visits to the site, a cookie may be installed automatically and stored temporarily in the device’s memory or on the hard drive. A cookie is an element that does not allow the User to be identified but is used to record information relating to the User’s navigation on the website. The Users of the site acknowledge they been informed of this practice and authorize the company to use it. They can deactivate this cookie by using the settings in their browser software.

Responsibility

The User is informed of the risks inherent in the Internet, particularly in terms of:

• lack of security in the transmission of data;
• lack of guarantee of continued access to the site or to the various services offered by the site.

Under no circumstances can the company be held responsible for these risks and the extent of their potentially harmful consequences for the User. Each User is responsible for taking all appropriate measures to protect his/her own data, software and hardware from contamination by viruses or any other forms of attack that may circulate through the Site or information published therein. The user agrees to bear the risks of unavailability of the server. Bottoms Up cannot be held responsible, in the event of interruption to the site at any time to modify or interrupt temporarily or permanently all or part of the Site, to carry out maintenance operations and/or make improvements and/or changes to the Site. The company cannot be held responsible for the inaccuracy of any content provided by Users of the Site. If errors or omissions are brought to the attention of the company, the latter reserves the right to correct them, and more generally to modify, at any time, without prior notice, all or part of the site without being held responsible for this. More generally, the company cannot be held responsible for any direct and/or indirect damage resulting from the use of this site.

Applicable law and jurisdiction

The non-compliance by the User, regardless of location, of any of the provisions of these General Terms of Use and more generally any difficulty relating to its execution, interpretation or validity, are subject to French law and the French courts.
